Contentious Probate

We have extensive experience of advising on all types of disputes that can arise in relation to Wills and Estates.

Will disputes can arise when the validity of the Will is in question. This may be due to undue influence, lack of capacity, or a failure to comply with legal requirements.  We act for clients on both sides of such disputes.

Sometimes beneficiaries are unhappy with the conduct of the executors or administrators of an estate. In these situations we can apply to Court on behalf of a beneficiary to ensure that they properly perform their duties, and if necessary, are removed from their office.  We also act for executors and adminstrators in opposing such applications.

There are also times when a dependant of the deceased has either been excluded from or been inadequately provided for in a Will. They may be a current or ex-spouse, the deceased’s children, or some other person who was financially supported by the deceased. We can bring a claim for adequate financial provision, and if necessary, apply to Court for an appropriate Order.

We can also advise and act on claims to an ownership of, or an interest in, Estate property.

Sometimes an original Will is no longer available, and reliance on a copy challenged. We can assist either the beneficiaries named in the Lost Will or the persons challenging it and, if necessary, bring proceedings.
